Novalogic, Inc. hat Rechtsstreit eingeleitet

Delta Force® die Rechte an diesem Namen und Logo hält NovaLogic Inc., doch
anscheinend hat Activision dieses nicht beachtet und das Logo von Delta Force®
sowie auch den Namen insbesondere in dem Call of Duty Teil MW3 verwendet.
Demnach ist der Vorwurf den NovaLogic nun Activision macht gerechtfertigt.

Auch gibt es ein Headset der Firma Turtle Beach im MW3 Look und dieses Headset
trägt ganz offensichtlich das Delta Force® Logo. Auch hat Activision anscheinend
weiteren Firmen die Verwendung des Delta Force® Logos in Anlehnung an MW3
weitergegeben und somit eine Lizenz erteilt für welche sie nicht mal die Rechte halten.
Eine XBox MW3 Sonder Edition mit Delta Force® Logo ist auf dem Markt. Activision hätte sich in diesem Fall eine Erlaubnis von NovaLogic Inc. einholen müssen, dieses wurde aber seitens Activision nicht getan.

Vielleicht dachten die Call of Duty Entwickler es wäre damit getan das Delta Force® Logo
ein wenig zu verändern (siehe Fotos unten), aber das war wohl nichts, denn es ist unverkennbar um welches Logo es sich handelt. Zudem wird der Name Delta Force® als Einheit in dem Spiel MW3 ja offensichtlich verwendet. Auch gibt es sogar Flaggen mit dem Delta Force® Logo in einigen Maps des CoD Elite Services.

NovaLogic Inc. sagt hier zu Recht: Es handelt sich hier um eine Markenverletzung und
unlauteren Wettbewerbs.

Vielen wird wahrscheinlich auch schon aufgefallen sein, dass die Homepage von NovaLogic
seit geraumer Zeit nun das Delta Force® Logo unübersehbar mehrmals auf der Homepage
platziert hat um nochmal klar zu stellen wer die Rechte an diesem Logo hält.

Hier ein kleiner Ausschnitt via Courtroom News - der Vorwürfe gegen Activision:

"The infringing mark's lightening rod is horizontal rather than vertical and a portion of the delta sign is set behind the dagger blade rather than being superimposed," according to the complaint.

"In single player mode, 7 of 16 missions are designated Delta Force missions, in which the only avatar available to players is 'Frost,' a Delta Force operator," the complaint states. "In addition, players fight alongside a number of non-player controlled characters. Several of these characters are members of Delta Force."

"In multiplayer mode, 7 of 16 mission maps have 'Delta Force' as one of the two factions that the player can select," NovaLogic says.

"At the time of this writing, Activision has released 6 additional multiplayer maps with infringing content. Activision plans to release additional content through their 'Elite Content' feature," it added.

"Despite Activision's irrefutable knowledge of NovaLogic's superior trademark rights, Activision created knockoff marks that are nearly identical [to] NovaLogic's design and word marks," according to the complaint. "Activision then shamelessly inserted these infringing marks throughout its competing first person military adventure video games.

"As if this were not enough, Activision has in-turn licensed the infringing marks to Defendants Voyetra Turtle Beach then shamelessly ('Turtle Beach'), Microsoft Inc. ('Microsoft') and the BradyGAMES division of Penguin Books ('BradyGAMES') without NovaLogic's permission. As a result of Activision's unauthorized licensing, Turtle Beach and Microsoft have created special editions of their products where the overall look and feel is entirely dominated by use of the infringing marks. In addition, BradyGAMES, a creator of videogame strategy guides and books, has reproduced NovaLogic's marks in its publications relating to defendants' game."

Release: Advanced Warfare 2 Mod Version 4.30

Gestern wurde die neueste Version des beliebten Advanced Warfare 2 Mods released. Ihr könnt diese ab sofort bei uns im Download Bereich bekommen.
Der Patch auf Version 4.3 setzt die Version 4.2 des Mods vorraus. Alle anderen älteren Versionen können nicht gepached werden. Bitte ladet euch in dem Fall die Full Setup Version herunter. Den umfassenden Changelog findet ihr unter der News. Viel Spass !!

Tester für die Delta Force: Angel Falls Alpha gesucht !!

Novalogic such Tester für die Alpha Version von Delta Force:Angel Falls. Jeder der VIP oder Goldmember bist kann sich dort Anmelden, allerdings werden wohl nur wenige angenommen ( ... many are called ... few are choosen )

Wer sich anmelden möchte , der kann dies unter folgender eMail Adresse tun: AngelFallsAlpha@novalogic.com

Novalogic benötigt in der eMail folgende Daten von euch:

- den vollständigen Namen
- eure Anschrift
- eine gültige eMail Adresse
- Novaworld Account PC-ID
- eure Computerspezifikationen

Weiter wird euer früheres Verhalten (im Forum/Game) sowie die Art wie ihr euch mitteilen könnt für die Auswahl entscheidend sein.

Vielleicht sieht man sich ja dann dort

Server Wartungsarbeiten

Wie auf der Novalogic Homepage zu lesen ist , finden ab morgen (14.09.) 3:00 Uhr Wartungsarbeiten statt. Vorraussichtich werden dann die Novalogic Homepage und Novaworld nicht erreichbar sein.
